1. General Provisions and Acceptance of Terms

1.1. Contracting Parties: These Terms and Conditions (the "Terms") govern the use of the web Platform theaestheticroi.com (hereinafter referred to as the "Platform"), operated by Alexandrina Ganganu (hereinafter referred to as the "Administrator").

1.2. Acceptance and Binding Force: Accessing and using the Platform constitutes the user's unconditional acknowledgement and full acceptance of these Terms, as well as the Privacy Policy. These Terms supersede any prior communications or understandings and create valid legal obligations between the user and the Administrator.

1.3. Updates: The effective date of the revised Terms is 12.10.2025.

2. Intellectual Property and Copyrights (IP Rights)

2.1. Exclusive Ownership: All intellectual property rights, including copyrights, trademarks, the trade name The Aesthetic ROI, as well as the trade dress and know-how of the Platform (texts, strategic analyses, images, design, and structure), belong exclusively to the Administrator.

2.2. Prohibition of Exploitation: Any unauthorized use of the content, including reproduction, public distribution, creation of databases, or commercial exploitation, is strictly prohibited without the express prior written consent of the Administrator. Such action will constitute a violation of national and international intellectual property protection laws.

3. Limitation of Liability and Disclaimer

3.1. No Professional Advice: The content and analyses published by the Aesthetic Strategist are provided strictly for general informational, educational, and entertainment purposes. They do not constitute and must not be interpreted as financial, tax, investment, or legal consultancy.

3.2. Assumption of Risk Clause: The user acknowledges and agrees that any action or omission based on the Platform's information is undertaken at their own sole risk. The Administrator makes no guarantees, express or implied, regarding the accuracy, completeness, or timeliness of the information and shall not be held liable for any direct, indirect, incidental, or consequential loss suffered by the user.

3.3. Force Majeure: The Administrator shall not be liable for the failure or defective performance of its obligations if such failure results from events beyond its reasonable control (including, but not limited to, cyber-attacks, major technical failures, or governmental acts).

4. Privacy Policy and International Standards

4.1. Standard Compliance: The manner in which the Platform processes personal data is governed by the separate Privacy Policy.

4.2. Extraterritorial Compliance: Although the Platform is operated from the Republic of Moldova, the Administrator is committed to adhering to the highest standards of data protection. Specifically, the Administrator complies with the principles of the General Data Protection Regulation (GDPR) of the European Union for the processing of data of users from the EEA (European Economic Area) and will respect the applicable extended rights conferred by specific legislation, such as CCPA/CPRA (for California residents, USA), to the extent these laws become applicable to our operations.

5. Governing Law and Competent Jurisdiction (Venue)

5.1. Governing Law: These Terms shall be governed by and construed exclusively in accordance with the laws of the Republic of Moldova, excluding its conflict of laws principles.

5.2. Exclusive Jurisdiction (Venue): Any dispute, claim, or controversy arising out of or relating to these Terms (including their existence, validity, or termination) shall be settled exclusively by the competent courts of Chișinău, Republic of Moldova. By accepting these Terms, the User irrevocably consents to the exclusive jurisdiction of the aforementioned courts.

6. Final Provisions

6.1. Severability: Should any provision of these Terms be deemed null or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
